Meeting Minutes

September 12, 2011

Call to Order: The Gregg Township Planning Commission Meeting held on Monday, September 12, 2011 was called to order at 7:03 by Chairman Chris Kunes.

CHAIRMAN'S REPORT:

Board of Supervisors Meeting Minutes – August 11, 2011: Mr. Bierly mentioned the CDBG from the Water Authority is due to be closed out. The Township has hired Bill Seigel from SEDA COG to help us with the close out process. The Paving Project will take place between now and October. Tar and Chip Seal of roads has been completed.

SUBDIVISION/DEVELOPMENT

Chairman Kunes brought forward the item concerning Jesse Peachey and the Liaison Report, in order to accommodate Mr. Hankinson and Mr. Peachey. Mr. Peacey is the new owner of Jodun's Sporting Goods Store in the village of Penn Hall.

1. Jesse Peachey: Mr. Hankinson, PVCEA, introduced Jesse Peachey and briefly explained the situation brought before the planning commission. Mr. Peachey purchased the above mentioned property and would like to put in Spring Lake Vinyl, a vinyl window shop. This would include a retail store/store front, storage and a facility to build/manufacture windows within the facility. The facility is currently zoned agriculture. He was unaware of the zoning before purchasing the property at an auction. Mr. Hankinson agreed that he is doing a nice job on the construction and is fixing up the facility. The assembly operation is what falls short of the conditional use of the Agricultural Zone. Ms. Mason asked if the assembly operation could be moved off sight. Mr. Kunes questioned the percentage of the operation that would be assembly/manufacturing. A zoning variance may be required for this business to fit in an agricultural zone. For change, Mr. Peachey would have to take this issue to the Zoning and Hearing Board. Neighbor and Gregg Township Resident, Greg Williams addressed the group expressing both pleasure and concern. He is happy that Jesse was able to purchase the property and is renovating and fixing up the structure but he is equally concerned with the noise that might be associated with manufacturing the windows and from the diesel needed to run tools/equipment. Ms. Mason expressed the Zoning Hearing Board is responsible for the change in the non-conforming use. She also expressed to Mr. Hankinson, that as the Zoning Officer for Gregg Township, he is solely and completely responsible for making this and any other zoning ruling. The board can decide whether to challenge the decision that is made.

2. Liaison Report: Mr. Hankinson reported that the transition for Smart Start to the facility down the Road went very smoothly. PVCC is now renting and renovating Room #103 at the Old Gregg School for a Youth Center. They have all the required permits. The plans were shown to the group for the new Youth Center.

3. Agricultural District Lot Subdivision Regulation: Section 304.D.2.b.5.: The Planning Commission had homework to go look over the Subdivision Ordinance and the changes that was discussed at the last PC meeting.

By email on Monday, September 12, 2011, Ms. Mason gave the Planning Commission her suggestion for wording of this section of the ordinance. Her suggestion was to change the ordinance to read, "Lots created by this ordinance, unless greater than 50% of the original parcel and at least 11.0 acres in size, shall never be further subdivided."

A discussion took place about this suggested change as well as the language that was discussed and reviewed at the August Planning Commission Meeting.

Following are some options the Planning Commission will review during the coming month and make any additional changes they feel necessary:

#1: Lots created by this ordinance, unless greater than 50% of the original parcel being subdivided and greater than 11.0 acres in size, shall never be further subdivided. (Mr. Bierly, Mr. Arthur and Ms. Mason are in favor of this option.)

#2: Lots created by this ordinance, unless greater than 50% of the original parcel being subdivided and greater than 11.0 acres in size, shall never be further subdivided, excepting lots of greater than "X" acres. (Mr. Kunes and Mr. Seay are in favor of this option.)

#3: Lots equal to or less than "X" acres created by this ordinance shall not be further subdivided.

APPROVAL OF PLANNING COMMISSION MINUTES: Mr. Seay made a motion to approve the August 1, 2011 Planning Commission Meeting Minutes as ammended. Second by Mr. Arthur. Motion carried

6 – 0.

FOR THE GOOD OF THE ORDER: Mr. Bierly mentioned to the group that the Penns Valley Regional Planning Commission will meet at the Old Gregg School on Monday, September 19, 2011 at 7:00 p.m. Sue Hannigan from the Centre County Natural Gas Task Force will be a presenter at the meeting.

Adjourn: A motion was made by Mr. Bierly to adjourn the meeting at 9:35 p.m. Second by Ms. Mason. Motion carried 6 – 0.
