 CALL TO ORDER The Public Hearing for Ordinance O-14-01 was called to order at 7:00 p.m. by Chairman Joel Myers.

PUBLIC COMMENTS Mr. Horner gave a brief synopsis of the Ordinance O-14-01 Weight Limits on Township Roads. The Supervisors are proposing to put weight limits on five of the Township Roads which include Decker Valley, Lingle Valley, Gingrich Gap, Blue Ball and Grenoble Road. Mr. Gary Horner asked about the local traffic clause. Mr. Russell Schleiden questioned how frequently we have non-local users on our road. He felt this Ordinance would target the logging industry. He also questioned the local traffic clause, who would be exempt and who wouldn’t.  He petitioned to the board to table the vote for further discussion.

No further comments. Mr. Myers closed the public hearing for O-14-01 at 7:26 p.m.

Board of Supervisors Regular Meeting Minutes

September 11, 2014

The Board met in an advertised work session at 6:15 p.m. prior to the start of the Regular Board of Supervisors meeting.

CALL TO ORDER Mr. Myers called the Regular Meeting of the Board of Supervisors of Gregg Township to order at 7:26 p.m. followed by the recitation of the pledge of allegiance.

MOMENT OF SILENCE A moment of silence was taken in memory of those that lost their lives on September 11, 2001.

PUBLIC COMMENT (For items not on the agenda): Mr. Dale Musser addressed the board concerning his outdoor wood burning stove at 113 Cooper Street, Spring Mills.  He would like to replace his old furnace with a new furnace and stated that his property is grandfathered. A discussion took place and the matter was referred to the Penns Valley Code Enforcement Agency for resolution. Mr. Myers would like to see the Board of Supervisors and the Planning Commission revisit the existing burn ordinance.

Mr. Grenoble addressed the board to see what maintenance is being done on Vonada Gap Road. Mr. Horner plans to grade the dirt road as soon as conditions are favorable.

O-14-01 Weight Limits on Township Roads Mr. Stover made a motion to table the ordinance until the October Meeting. Mr. Bierly was not in agreement to table the vote. He would like to see this move forward as this ordinance is not directed to local people but only towards those that damage the roads. Second by Mr. Myers. No further discussion. Motion carried. 2 – 1 Mr. Bierly voted in opposition to this motion. The Ordinance will be on the agenda at the October meeting.

LIAISON REPORTS

Solicitors Report:  Mr. Rayman reported the status of the Musser Case. He wrote a letter stating we are not consenting to further arguments and no further paperwork would be filed. No judgments have been made. Mr. Rayman also discussed the proposal with the Tri-Municipal and DCNR. Mr. Bierly made a motion to approve the proposal by DCNR to have the area designated  for the cell phone tower set out, an appraisal of the property done and Verizon to pay the appraised amount of the property. Second by Mr. Stover. No further discussion. Vote in favor was unanimous. 3 – 0

Mr. Stover made a motion to approve the grading sketch of the Tri-Municipal Park with minor changes and submit it for the HOP. Second by Mr. Bierly. No further discussion. Vote in favor was unanimous. 3 – 0

Mr. Rayman was dismissed at this point.

Old Gregg School Advisory Committee: Ms. Burrows was not in attendance.

Emergency Management Coordinator/Fire Company:  Mr. Grenoble will be attending a quarterly training next Thursday at Accuweather. The group discussed the Joint Meeting to be held on Monday, November 24 at the Penns Valley High School with representatives from area Fire Companies and Municipalities.

Penns Valley Code Enforcement Agency (PVCEA): Mr. Lesnaik presented the Board with the monthly report and pointed out pertinent information to the board.     

Penns Valley Emergency Medical Association (PVEMA): Mr. Leary reported that the ambulance subscription cost will increase this year. Ms. Snyder reported that we have not received anything back from the other municipalities regarding the agreement that was to be signed in regards to the Volunteer Workers Compensation. Ms. Snyder will follow up with Mr. Rayman.

Penns Valley Regional Planning Commission (PVRPC): Mr. Bierly reported the Regional Planning Commission will meet on Monday, September 15, at the Old Gregg School at 7 p.m.

Gregg Township Planning Commission:  Mr. Bierly reported that there was no Planning Commission meeting held in September.

Rails to Trails:  Nothing new to report.

Tri-Municipal Park: See above discussion. Mr. Myers reported the next step for the park board is to get a cell tower on the park land for the income it can provide. He explained that all three municipalities have to be in favor of any decision that is made concerning the park which makes things move slowly.

Water/Sewer Authorities: Mr. Horner said Rural Water helped them find and fix a couple of leaks in the Township. They are hoping to finish the tanks at the sewer plant but this may get pushed off until Spring.

SECRETARY/TREASURER’S REPORT

Meeting Minutes: Mr. Bierly made a motion to approve the August 14, 2014 regular Meeting Minutes. Second by Mr. Stover. No further discussion. Vote in favor was unanimous. 3 -0

Checking Account Detail:  Mr. Stover made a motion to accept and approve the Checking Account Detail/Monthly Financial Report as presented. Second by Mr. Bierly. No further discussion. Vote in favor was unanimous. 3 – 0

Mr. Stover made a motion to allocate up to $900 to purchase a new copy machine for the office. Second by Mr. Bierly. No further discussion. Vote in favor was unanimous. 3 – 0

Mr. Stover made a motion to transfer $125,000 to a CD at 1% interest at Jersey Shore State Bank. Second by Mr. Bierly. No Further Discussion. Vote in favor was unanimous. 3 – 0

ROADMASTER REPORT

Mr. Horner reported that the Board conducted a tour of the Roads. They will finish that last of the mowing on Sinking Creek. He explained the Township mows this state road in exchange for salt brine which is part of the Penn DOT Agility Program. There have been lots of calls about the fill behind the school. The F550 is in the shop for repairs. They will be grading the dirt roads as soon as the can.

Mr. Myers mentioned that on the Road Tour the bridge at Muddy Creek was discussed. Mr. Stover has been checking on the permits needed for this project.  He indicated that we need a G3 permit and that no engineering was needed. The Fish Commission would need to be notified. Mr. Horner indicated that due to the complexity of this project, we would need to put it out for bid. Mr. Stover reported that he had someone who can draw up the plans at no cost. Discussion of where the funding would come from took place. Mr. Stover indicated that the permits will last indefinitely.  Mr. Myers directed Mr. Stover to go ahead with the permits.

OLD BUSINESS

Musser Property: Musser v. Gregg Township, et al. (Case No. 2011-4845): See discussion above.

Codification:  Nothing new to report

Electricity at the Ball field: The check for West Penn was given to the Little League to move forward on this.

Playground:  The Playground committee will hold a kickoff meeting will be held on September 23, 2014 at 6:30 p.m.  Mr. Horner donated a mailbox to collect donations for the playground at the Old Gregg School.

NEW BUSINESS

Joint Meeting with PV Regional Municipal and Fire Company: See discussion above.

Centre County Association of Township Officials (CCATO):  All three Supervisors and Ms. Snyder will attend.

Millheim Pool Meeting: There will be a meeting with municipal representatives on Monday, September 22 at 7 p.m. at the New Hope Church. Mr. Stover will be attending as our representative.

PSATS Trustees Insurance Program- Resolution approving amended and restated declaration of trust R-14-09: Mr. Bierly made a motion to approve Resolution R-14-09. Second by Mr. Bierly. No further Comments. Vote in favor was unanimous. 3 – 0

OTHER BUSINESS

Old Gregg School Solar Domestic Hot Water: Mr. Bierly discussed with the group the grant that he had written for solar domestic hot water. The grant was written for $39,000 but it was funded for only $20,000. No funds for the General Funds would be used for this. He proposes that the Old Gregg School borrow money to pay for the remaining $19,000 at 3% interest and pay it back from the Old Gregg School revenue. They need to sign an agreement with West Penn Sustainable Energy Fund to get started with this grant. Mr. Bierly made a motion to move ahead with this grant and sign the agreement with West Penn Sustainable Energy Fund and go ahead with a loan from Jersey Shore bank when needed provided no general funds are used. Second by Mr. Myers. No further discussion. Motion carried. Vote 2 – 1. Mr. Stover voted in the opposition.

Joint Session:  Mr. Myers would like to have a fall Joint Meeting with Township Officials, businesses and the public. He would like to see open dialog with the various groups. Feedback or ideas are welcome for this meeting. A meal would be provided without tax payers’ expense.
