Board of Supervisors Meeting Minutes

August 14, 2014

The Board met in an advertised work session at 6:15 p.m. prior to the start of the Regular Board of Supervisors meeting.

ATTENDANCE

Supervisors: Chairman Joel Myers, Douglas Bierly, Charles Stover

Others in Attendance: Roadmaster Laron Horner, Secretary/Treasurer Jennifer Snyder, Solicitor Robert Rayman, Emergency Management Coordinator Don Grenoble, Old Gregg School Advisory Board President Jane Burrows, Gary Horner, Catherine Smith

 CALL TO ORDER The Gregg Township Board of Supervisors meeting held on August 14, 2014, was called to order at 7:00 p.m. by Chairman Joel Myers followed by the Pledge of Allegiance.

PUBLIC COMMENT (For items not on the agenda): Jake Tanis from Potter Township addressed the Board concerning the Tri-Municipal Park.  The Potter Township Supervisors voted to cancel the lease for the park ground and put it out to bid at the first of the year. They need to give the tenants 90 day notice before terminating the lease. They are hoping they can get $100/acre for someone to lease the ground. Mr. Bierly made a motion to support the termination of the lease for the Tri-Municipal Park ground. Second by Mr. Stove. No further discussion. Vote in favor was unanimous. 3-0  Discussion of the cell phone tower being permitted on the park ground took place. Mr. Stover made a motion to state that the Gregg Township Board of Supervisors would support the exchange of land for the Verizon cell phone tower to satisfy the Department of Conservation and Natural Resources regulations. Second by Mr. Bierly. No further discussion. Vote in favor was unanimous. 3-0

LIAISON REPORTS

Solicitors Report:  Mr. Rayman reported the status of the Musser Case. A motion to appeal to the Superior Court’s decision was not filed however they did file a motion for re-arguments before the Superior Court. Mr. Rayman feels we should send a letter in response to their request for re-arguments stating that we didn’t agree with this and we are not going to file a formal answer. 

Mr. Rayman received a letter from Mr. Franson in regards to posting weight limits on six roads which includes 5 dirt roads and Grenoble Road.  He will put together an ordinance and then we can advertise for a public hearing. Mr. Bierly made a motion to advertise an ordinance to post weight limits on 6 of the roads in the township and hold a public hearing on September 11, 2014. Second by Mr. Stover. No further discussion. Vote in favor was unanimous. 3 – 0

Mr. Rayman was dismissed at this point.

Old Gregg School Advisory Committee: Ms. Burrows, President of the Old Gregg School Advisory board reported that the board met last week and reviewed the financial reports and looked at the budget for 2015. As of August 15, 2014, the Old Gregg School is 100% rented with a waiting list of possible tenants. The Penns Valley Youth Center did a service project for the school. The Playground committee has created an online donation site to raise money for the playground. The Nittany Valley Model Railroad Club will be conducting an OLLI class on model railroads. There will be a dance held on August 16 at the center. Movie Night will take place August 30 which will show a WWI movie. Open Mic night will be held September 13th which is their one year anniversary. The annual craft fair will be December 13.  Mr. Myers suggested that Ms. Burrows meet with Ms. Snyder to go over the budget for next year.

Emergency Management Coordinator/Fire Company:  Mr. Grenoble expressed thanks for help at the recent carnival and for the Township participating in the parade. There have been some spotty storms around that have been hard to keep up with removing limbs and debris in the roadway. The water has really created trouble. Mr. Myers asked if there is a financial report yet from the details of the carnival. Mr. Grenoble said that Mr. Johnson still has the report but would see that we get a copy of it. Ms. Snyder will put something in the Township Newsletter in the Grapevine. There was nothing else to report.

Penns Valley Code Enforcement Agency (PVCEA): There was no one representing the PVCEA at the meeting.  Mr. Lesniak emailed agency reports to the Board of Supervisors.   

Penns Valley Emergency Medical Association (PVEMA): Mr. Leary was not in attendance to report.

Penns Valley Regional Planning Commission (PVRPC): Mr. Bierly reported the Regional Planning Commission met in May and will meet again in September.

Gregg Township Planning Commission:  Mr. Bierly reported that the Planning Commission met on August 4. They reviewed the revised final draft of the Code of Ordinances and discussed the proposed weight limits ordinance. They made a motion to adopt the final draft of the code after their review. They talked briefly about the Right of Way for the Rails to Trails as it concerns Chris Kunes property. They also discussed the 10 year review of the Penns Valley Comprehensive Plan.

Rails to Trails:  Nothing new to report. Ms. Snyder reported there is still a balance in the Rails to Trails checking account but she expects to get a final invoice soon.

Tri-Municipal Park: See above discussion for more information regarding the Tri-Municipal Park. Mr. Myers will miss the meeting that is scheduled for Tuesday, August 19 as he will be out of town. Mr. Jim Evans, appointed as a member of the Tri-Municipal Board for Gregg Township expressed to the Board that he cannot attend all of the meetings that are held and feels like he needs to step down. Mr. Bierly made a motion to appoint Pat Leary as another representative to the Tri-Municipal Park Board for Gregg Township and Jim Evans as an alternate member of this board. Second by Mr. Stover. No further discussion. Vote in favor was unanimous. 3-0 

Water/Sewer Authorities: Mr. Horner reported that the Water Authority fixed a leak with the help from Rural Water. The Sewer Authority just finished with the tank inspection and cleaning.  Mr. Horner will get the results at the Sewer Authority meeting on Monday night and then can report to the Board of Supervisors next month.

SECRETARY/TREASURER’S REPORT

Meeting Minutes: Mr. Bierly made a motion to approve the July 10, 2014 regular Meeting Minutes. Second by Mr. Stover. No further discussion. Vote in favor was unanimous. 3 -0

Checking Account Detail:  Mr. Stover made a motion to accept and approve the Checking Account Detail/Monthly Financial Report as presented. Second by Mr. Bierly. No further discussion. Vote in favor was unanimous. 3 – 0

Mr. Stover made a motion to transfer $3050 back from the Old Gregg School Fund to the General Fund Savings Account that was previously borrowed. Second by Mr. Bierly. No further discussion. Vote in favor was unanimous. 3 – 0

Discussion took place concerning the copy machine. We pay $60 or more a month to rent this machine. We make up to 300 plus copies a month. Ms. Snyder thinks we can get a larger color copier and laser printer that could replace this machine and spend about equal to what we pay for the rental in a year.  Mr. Stover made a motion to get rid of the lease on the existing rented copy machine. Second by Mr. Bierly. No further discussion. Vote in favor was unanimous. 3 – 0

ROADMASTER REPORT

Discussion took place concerning the radios that were installed in the trucks as a demo. There are 4 radios and 2 handheld units. Mr. Horner reported that they had a lot of success with the radios and would suggest that the Township purchase them.  Mr. Stover questioned the need for cell phones and radios. Discussion took place. Money from the Act 13 Funds could be used towards the purchase of these radios. Mr. Bierly made a motion to purchase 4 radios, one for each truck and 2 handheld units for approximately $2468 and use the Act 13 funds for this purchase. Second by Mr. Myers. No further discussion. Vote in favor 2 – 1. Mr. Stover voted in the opposition. Motion carried.

Snow fence: Mr. Horner asked the Board if they want the road crew to install snow fence again this year. About 25 rolls of damaged fencing were thrown out last year and would need to be replaced. Discussion took place. The board asked Laron to get a price for the cost to replace the junk fence and bring it to the board meeting next month so they can make a decision.

The crew replaced 3 culvert pipes on Green Grove Road and Lower Georges Valley road.  The Crack Sealing machine was returned. The cost was $4967. The crew has made good use of the power broom cleaning up after several storm. They have also started grading roads. They removed a tree on Blue Ball Road which came down after a storm and will begin the second round of road side mowing next week.

OLD BUSINESS

Musser Property: Musser v. Gregg Township, et al. (Case No. 2011-4845): See discussion above.

Codification:  See the discussion above about the weight limits.

Electricity at the Ball Field: Ms. Snyder got an email in regards to the invoice from West Penn. She will be in contact with the Little League and get a check cut out of the Recreation Fee In Lieu Fund for our half of the invoice which is $3318.84.

Playground:  The Playground committee met again and will hold a kickoff meeting will be held on September 23, 2014 at 6:30 p.m.  Light refreshments will be served and possible babysitting. We need to check with DCNR about selling existing playground and the liability involved in that.

R-14-08 Budget Amendment Resolution: Mr. Bierly made a motion to accept Resolution R-14-08 Act 13 Budget Amendment. Second by Mr. Myers. No Further Discussion. Vote in favor 2 – 1. Mr. Stover voted in the opposition. Motion carried.

NEW BUSINESS

Weight Limit Ordinance:  See discussion above.

Centre County Library & Historical Museum Donation Request: The Board discussed. No action was taken.

Mifflinburg Bank and Trust: Ms. Snyder was asked to look into this. She will get back to the Board.

Old Gregg School – Mr. Rooter Estimates: The estimate was $2240 to replace 6 faucets. Discussion took place. The Board would like to see some additional quotes before moving forward. Mr. Bierly will look into it.

Old Gregg School – Grants: Mr. Bierly discussed the grant that was written and awarded for solar panels and a hot water storage tank. They were awarded $20,000 for a $39,000 project. These solar panels would preheat hot water. He doesn’t want to see us lose this money. Discussion took place. Another grant that Mr. Bierly is writing is to install LED dusk to dawn lights on the building. It would save us $700/year. The total cost of the project is $16,865. The total being asked for is $14,877. The Township would upfront the cost for these funds and would be reimbursed after the money is spent. There is an in-kind donations of $1988 written into the grant. The cost to file for the grant is $150. Mr. Bierly made a motion to spend $150 to submit this grant. Second by Mr. Stover. No further discussion took place. Vote in favor was unanimous. 3-0

Roof Repair: Mr. Stover and an associate are willing to volunteer their time to patch the roof of the Old Gregg School. They expect the project materials to cost no more than $600. Ms. Snyder would need receipts or an invoice to pay for the supplies needed. Mr. Myers made a motion to approve up to $600 to repair the roof of the Old Gregg School. Second by Mr. Bierly. No further discussion. Vote in favor was unanimous.

3.       Penns Valley Park & Recreation Letter concerning meeting date in September: Either meeting dates work for Mr. Stover to attend. Ms. Snyder will let them know.

The meeting correspondence was reviewed and discussed.
